OCR Explores HIPAA Barriers to Conducting Criminal Background Checks

The HHS Office for Civil Rights expects soon to publish a request for information on barriers related to HIPAA privacy and security rules that could prevent states from making certain information available to the National Instant Criminal Background Check System.

HHS has sent the RFI, in the form of an “advanced notice of proposed rulemaking,” to the Office of Management and Budget for review, which is one of the last steps before publication. The request for information is in response to one of 23 executive orders related to gun control that President Obama signed on January 16.

OCR will seek input from states, other stakeholders and the general public to inform possible development of a proposed rule.
