A new Frequently Asked Questions document from Department of Health and Human Services explains applying substance abuse confidentiality regulations to health information exchanges.

The regulations govern the use and disclosure of information about alcohol and drug abuse in patient records maintained at federally funded substance abuse programs. The FAQs are not meant to provide legal advice but to give guidance to individuals, providers, policymakers and HIE technology developers.

The HHS Substance Abuse & Mental Health Services Administration and Office of the National Coordinator for Health Information Technology developed the FAQ. It is available at samhsa.gov/HealthPrivacy.
