The HHS Office for Civil Rights has issued guidance on application of specific HIPAA privacy rule provisions following last years Supreme Court ruling that Section 3 of the Defense of Marriage Act is unconstitutional.
The OCR guidance clarifies rights that lawfully married same-sex couples have under HIPAA provisions. Following is the guidance in its entirety.
